NIGERIA: CLARIFICATION: Eligible Customer Regulation NOT SUSPENDED

We wish to clarify that the Eligible Customer Regulation has not been Suspended contrary to our previous publication. However, the Nigeria Electricity Regulatory Commission (NERC) suspended the Eligible Customer transactions for unapproved customers.

The Commission has suspended all unapproved Eligible Customer transactions and directed the Transmission Company of Nigeria (TCN) to suspend such transactions. The eligible customer policy allows the generation companies (GenCos) to sell power directly to high consumption customers.

The TCN, in a letter to all eligible customers, signalling compliance with directives of NERC, said, ”Following a letter from the Nigerian Electricity Regulatory Commission (NERC) dated 7th July 2021, the commission ordered the suspension of all Eligible Customers transactions without its approval.”

”In this regard, we write to formally notify you that the MO/TCN is abiding by this directive and will credit all affected Eligible Customers associated energy to their host DisCo. We advise that all Eligible Customers follow up their license application with the commission.” the letter read.

The Commission will carry out a review of all pending eligible customer license applications.
