- NERSA ordered to process the utility’s tariff application
A High Court in South Africa has ruled in favour of the state-owned electric utility, Eskom. Eskom, in a lawsuit, asked the High Court to rescind the decision of the National Energy Regulator of South Africa’s (NERSA) to reject Eskom’s tariff application.
In his ruling, Judge Jody Kollapen stated that the energy regulator could not reject the application of Eskom based on a tariff methodology that hasn’t been approved or implemented. While Eskom filed a lawsuit against the rejection of its three-year tariff application for 2022, 2023 and 2024, the High Court issued an interim order to NERSA to process Eskom’s tariff application for the 2022/23 financial year only. The High Court will issue a final ruling later.
In its tariff application, Eskom is seeking to increase electricity tariffs by 20%.
