TANZANIA: Pan Africa Energy Loses Lawsuit Against Revenue Agency

  • Pan Africa Energy loses its appeal against Tanzania’s revenue agency
  • Appeal Court says it is satisfied with the decision of the Tribunal court

The Tanzanian Court of Appeal has dismissed a lawsuit filed by Pan Africa Energy Tanzania Limited over the TZS84 billion tax invoice issued by the Tanzania Revenue Authority (TRA). In their ruling, the Court of Appeal Justices Stella Mugasha, Rehema Kerefu and Issa Maige said they were satisfied with the lower Court’s decision.

“We are satisfied that the Tribunal was justified to strike out the appellant’s appeal on account of being preferred to the Board against a non-appealable decision. Thus, we find no cogent reasons to reverse the decision of the Tribunal and the appeal is hereby dismissed with costs”, the Court of Appeal ruled.

“In the same vein, in the absence of any inconsistencies in the provisions in question that the refusal to grant the waiver is neither a tax decision nor an objection decision which can be appealed against before the Board”, they said.
